Racial Disparities Occur in Death Sentencing Across the USA:

• The race of the victim and the race of the defendant in capital cases are major factors in determining who is sentenced to die in this country.

• In 1990 a report from the General Accounting Office concluded that "in 82 percent of the studies [reviewed], race of the victim was found to influence the likelihood of being charged with capital murder or receiving the death penalty, i.e. those who murdered whites were more likely to be sentenced to death than those who murdered blacks."

For the Innocence Project, the vast majority of the people released who were serving 10, 20, 30+ year jail sentences were black.

This paper employs meta-analytic methodology to evaluate the research results of a number of sepa-rate race and sentencing studies in the context of three competing theoretical frameworks (the differen-tial involvement, direct-impact, and interactionist perspectives), and the empirical evidence supportingeach. The data indicate that although the effect size of race on sentencing is not statistically significant at this level of aggregation, its relationship to sentencing is significantly conditioned by the measure-ment techniques employed by researchers. Specifically, this study shows that certain methods of classify-ing racial groups may mask the true effect of race on sentencing decisions. The implications of this find-ing for future research are discussed.

A meta study is a study which aggregates the results of previous studies on a topic and presents a conclusion. What meta studies on legal racial discrimination often find is little systematic difference at the base skin color level. While in the past it was easy to find discrimination this level, courts all over the country hide obvious evidence of discrimination. By courts, I mean lawyers and judges, one of the smartest professions. So to find discrimination which we all know happens, you have to look at the issue at a *deeper* level. What researchers have found is that discrimination begins to bear itself out as people get blacker and more stereotypically Negro appearing, because whites have an implicit bias against these people on a level they cannot control. It's only then that the discrimination becomes systematic. Otherwise it is not. Do you understand? Not all discrimination which supposedly happens to blacks, literally happens to every person described as black. Confounding issues exist. Do you understand?

Accused killer Joseph Robert Patterson, 28, of Sioux Falls is now being held on a $1 million cash-only bond after allegedly kidnapping and attacking the slain boy's mother at her apartment early Tuesday.

Patterson, who has a history of domestic incidents, had been free on $750,000 bond after being charged in Tyrese Peterson's tragic death in October 2013.

He was ordered to stay away from the boy's mother, whom he was living with at the time of the boy's death, as well as anyone else in her family.

Instead Patterson allegedly visited the woman at her apartment and choked her twice, causing her to lose consciousness, the Argus Leader reported.

"Mr. Patterson is a danger to both the victim and the community," Judge Joni Cutler said at Patterson's court appearance Wednesday.

He was booked into the Minnehaha County Jail early Wednesday morning on charges of aggravated assault, interference with emergency communication, kidnapping and damaging property, jailhouse records show.

Meanwhile Lincoln County State's Attorney Tom Wollman has reportedly filed a motion to revoke his previous $750,000 bond on the 2013 murder case.
