as far as due process, im of the belief that the consitution, the amendments, bill of rights and other things should only apply to citizens, and people seeking asylum for the right reasons.

Therein lies the problem. The Constitution enumerates rights and protections for citizens, while enumerating rights for all people within our borders. In the meantime, treat people fairly until you change the Constitution.
