He was essentially a Disney employee and they are known for having code of conduct clauses in their contracts. His stunt more than likely broke that. What does the above have to do with any of this?

There is a high probability Disney/ESPN has a code of conduct for what their employees can be seen doing in public. If he agreed to said code of conduct as a term of employment that's on him for agreeing to it. If they don't have that yeah he should totally sue. I'm willing to bet given the fact that this way years ago and he hasn't sued they had a code and his behavior violated it.
