My only questions about this case are:

1. Can a dude be charged with rape if the condom broke during intercourse?

2. Can a woman be charged with rape if she told a dude that she was on the pill; even though she wasn't?

So what should the charge be if not rape?

None. If somebody willingly lays down with somebody then they assume risks; including the fact that they maybe laying down with a complete scumbag. She clearly didn't know this guy and couldn't trust him as much as she thought. What is the difference between a woman telling a man that she can not get pregnant, but then ending up pregnanat? Should that woman be charged with rape? Should that guy be able to claim that he was raped?
