Under the arbitrary and capricious standard, the league is going to have a difficult time explaining why the punishment were so egregious compared to those previous similar infractions. The league is going to have to show why the punishment wasn't arbitrary and capricious.
Even under the "conduct detrimental to the league" standard, Goodell will have a hard time explaining what exactly Brady did that warranted the punishment. Keep in mind that the league doesn't get a second chance of proving why Brady's guilty; Goodell has to prove that Brady's conduct was detrimental to the league based on its findings in the Wells report. If the league tries to bring up Brady's non willingness to hand over his phones and emails, the league will only open itself up to more issues because guiding labor laws prevent employers from punishing employees for refusing to hand over their personal phones, etc.
The league could end up having lots of egg on its face.

I'm sorry you don't understand how this legal process works.
The point is that the onus is on the league to prove based solely on the Wells report findings that Brady's punishment wasn't arbitrary and capricious and that Brady engaged in conduct detrimental to the league.
With the report's findings, it's unlikely that the league has sufficient evidence under the preponderance of the evidence standard. The report has way too many holes, conjecture and omissions.
So legal jargon aside
