You can't drive past the police station and a criminal trial AND THEN beeline straight for civil court. People forget that you can try the case in criminal and still sue in civil afterwards (that's what happened with OJ).

By avoiding the DA office, it comes across like a money grab. Burden of proof is lower in civil trial (preponderance of evidence vs beyond reasonable doubt)....and you're less likely to have someone dig into your personal life.

If you're brave enough to face someone in civil court, you should be brave enough to face them in criminal court. Only reason you don't is because you know your story got some holes in it.

Even if the DA declines to take it to trial, at least go that route first. It makes your story more believable. Otherwise I'm gonna assume you just want money and are hoping he settles out of court.
