I might be wrong but can't they charge the one who survived with his death of they want to? The whole thing about committing a crime that directly or indirectly causes one of the suspect's death. Forgetting the term for it.
I don’t think it would apply either way but the friend wasn’t driving so he didn’t commit a crime.

The deceased's family could file a wrongful death civil suit especially if they feel he wasn't the one driving

Felony murder is the charge but if he’s never convicted of a crime there’s no felony murder. You have to be with somebody in the commission of a crime like selling drugs or robbing someone.
