Everyone uses the same gimmick. You didn't see Mr Anderson drop the mic from the ceiling in tna? Didn't see 'team 3D' in tna?
They had to change their name to Team 3D instead of the Dudley Boys and couldn't even be called Bubba Ray and Devon Dudley in TNA.

And the mic thing isn't really something you can trademark...but an entire storyline centered gimmick like the "Broken Universe" you can.
That is why you would never be able to see Bray Wyatt leave WWE and continue the Sister Abigail stuff. That is owned by WWE.
On top of Cody not being able to use his dad's last name he also can't paint his face and do the Stardust gimmick.
Just like Dustin couldn't paint himself gold and use the Golddust gimmick when he left WWE and returned to WCW.

It's a PR disaster that is going to already sully the reputation of the "new" regime.
Everyone freely admits that Jeremy Borash was deeply involved in the creation of the Broken stuff and there really is no valid argument against TNA have ownership of something that started and became popular on their TV show. But I agree that going after the Hardys like this is lame as fukk on TNA's part.
They will never come out of this situation looking good and considering how shytty the company's rep is already it just seems really shortsighted to fight this battle that is really not going to end up benefiting TNA or Anthem in any way moving forward.
Its just really really dumb.

Sure it does. Broken Matt Hardy was trademarked last week by Matt Hardy. What part of the broken universe does TNA holds specific copyrights to? Is there a trademark filing for 'Senor Benjamin"? "Delete Delete Delete"? "Vanguard 1"? No. Cody Rhodes, for example, is trademarked by WWE in black and white to represent a character, and not Cody Runnels. Matt and Jeff were known to have contracts with no exclusivity (they appeared in ROH in December) so how could Matt have possibly signed over his character rights if he didnt sign over exclusivity? How many wrestlers in TNA has had characters started or made popular in WWE? Wanna count with me?
