when I was like 21, I was shytfaced and I knew I couldn't drive so I hopped in my passenger seat in the parking lot and put the seat back so I could sleep it off for a while. this was way before uber came out, and the police rolled up on me and damn near tried to arrest me. I wasn't doing shyt but sleeping in my passenger seat. yeah I was fukked up, but I most certainly wasn't trying to operate a motor vehicle.

I almost caught one years ago. After the club it was raining like crazy and I was too drunk. I already knew the game so put my keys in a bush.

Cop knocked on my window, made me blow and said I “give me the keys you’re under arrest for DUI”. I said i don’t have the keys and you can look. He spent about 20 minutes looking for the keys before he gave up. I was legally parked so there was nothing he could do.

But yes you can def get A DUI for a non moving car
