Exactly, It sounds bad but I'd kill the one. If I was ever charged I'd use a Justification Defense or maybe Offense Modification, the law isn't as rigid as people think it is, extraordinary/mitigating circumstances could lead to someone being found not guilty.

I would not touch the lever. By doing such, you are now causing the death of that one man, however if you do nothing, you are merely a bystander that has no obligation to help anyone.

Now, as a human being though, being stuck in that situation would haunt me either way.
