They just throwing out pre-civil rights style policy and no one is really pushing back on none of it.
Kinda iffy to say it violates the constitution because this policy happens outside of the country. And these relationship trysts occur outside the embassy. The Constitution doesn't protect you outside of US soil. Its the reason they want to keep Guantanamo so badly.
There is an argument here for freedom of association being violated, but this association would be outside of US jurisdiction in the PRC so that protection wouldnt necessarily apply.
Equal protection clause could be triggered but the govt attorneys could argue that the law applies to all contractors and govt employees equally. And the chinese national wouldnt get equal protection at all since she never entered the US. The boundary case for this would be if embassy staff brought a chinese womam onto a naval ship or into an embassy to smash because then US laws may apply to them in that one niche scenario due to UN convention and flag of convenience laws for sea vessels.
The only real straw you could grasp against this may be that the whole policy is executive branch overrach but to my knowledge; there is no law passed by congress that says the govt cant control who you fck outside the country if you are a federal employee or contractor. And since the executive branch controls a lot of DOD and cabinet jobs , that branch as your employer can concievably have the right to regulate the terms of your employment.
