I’m aware that the lawsuits exist. But my point is most of the racial discrimination in Corporate America falls out of the scope of the lawsuits. Those lawsuits involve blatant discrimination which most corporations avoid.
The only thing allowing corporate to do what your saying to applicants (when the EEOC was functioning like designed) ignorance of their rights


lowkey if you think they didn’t hire you because you was black, you are suppose to file a complaint with EEOC and get an investigation going on and if they find that it looks like race is a factor in hiring you can file a multimillion dollar lawsuit.

What you’re describing is a problem due to inactivity or misunderstanding . It’s not a loophole companies can do and no one is aware that they do it. The issue is with the EEOC basically rolling back its services, unless you have a state agency to do the task, there is no one to call, unless you get a private attorney who is going to have to take a risk something comes up in discovery to prove your point. Which realistically isn’t going to happen. So in states with shyt versions of equal employment agencies (aka most red states), workers right now really don’t have protection from discrimination in employment.

This would've happened regardless of who won. Part of the "white-lash" against Kamala winning would've been cac middle managers being even more racially biased against Black applicants. And Kamala probably would've expanded the H-1B visa program.

your argument makes no sense. There's no historical evidence corporate America becomes “more hostile” to black ppl under Democratic administrations (including the only black one in Obama). If anything, enforcement increases and protections expand. So the EEOC would've still been there and Labor dept oversight would've still been there. yes structural racism like bias in hiring would still exist. BUT you would still have strong measures in place to keep companies in check. that is the big difference

Bothsider thinking is saying "well there's still structural racism so let's just throw the whole thing out. We don't need no EEOC anyway"

Now with Trump back in office and EEOC dismantled, any type of discrimination lawsuit is much harder to win. and private employers have little to no incentive at all to follow rules

Corporations by and large follow whatever legal or regulatory environment the government establishes. If it was Kamala, we would've likely seen more of what we saw during Biden's term. equity programs still in place and likely expanding. you'd also probably have banks and more companies still publicly committed to racial equity programs. No surprise as soon as Trump took over, they dropped all of it.
