typically you get a TM so other people cant use and profit off your shyt. does this allow anyone to use the name or...and/or logo and its likeness or what?

I don't know much if anything re: patent law, but I do know there're at least a couple levels The Danny/the team can take this to. As mentioned upthread they already won an appeal on this a while back, supposedly on a "technicality", but it's not clear what that "technicality" was. Nor is it clear as to how it would be any different this time around.

ETA: Just found what the technicality was.

The decision by the Trademark Trial and Appeal Board is similar to one it issued in 1999. That ruling was overturned in 2003 in large part on a technicality after the courts decided that the plaintiffs were too old and should have filed their complaint soon after the Redskins registered their nickname in 1967.

pretty much. Offensiveness is pretty subjective...this will drag on for a while if this is the route the gvt wants to go. Chances of winning this seem slim.
