Their basis for an appeal is pretty slim.

Essentially, this ruling says “we ain’t MAKING you change it, but you might as well.”

Under federal trademark law, if a trademark is considered disparaging to certain individuals or “brings them into contempt or disrepute”, as the law states specifically, then they have full authority to reject the trademark. That’s what they’ve done here.

NOW…this doesn’t mean the Redskins have to change their name. But they might as WELL, because what it DOES do is limit their legal options when other people start using that logo and/or name on merchandise, as others have said already.

So ANYBODY can use that name...it's almost "tainted" now and therefore not NFL-exclusive.

The real story here is the fact that the Native American lobby is FINALLY vibrant enough to secure the clout to effect this. That’s why they were rejected in the past, not enough clout.

Yeah, the appeal does seem thin. I guess the Redskins could argue the trademark was approved and has been standing for a couple of decades now. They haven't done anything with the name that would violate the terms of the trademark more like a changing of the times is why the trademark was finally rejected.

Yeah, that’s their only shot, big dawg….and it should prove to be a pretty compelling argument. I'd LOVE to read their appeal brief. Hell, I wish I wasn’t mired in new cases, lol, otherwise I would take the time to research the PRECEDENT for this. Cause I know there’s gotta be some case law where the use of a trademark was at issue in a similar fashion.

Looks like it, dawggie. The only way this resolves otherwise is if the Patent and Trademark Office vacates this decision, which is highly unlikely.

I mean, I GUESS the Redskins could adopt a new logo that looked similar except had a slight change, in the hopes of getting THAT approved.
