It's going to go to federal court. They will lose badly. They are under no obligation to determine what that person's status is. The only obligation is to provide transportation fairly, which they did. NYC has no power to restrict access based on someone's financial status. :russ: Funny how no one is suing the airlines who were transporting people. It's a BS case and NYC is desperate.

A charter bus company hired by the state of Texas to transport migrants to Chicago is trying to flip the script on the border crisis in a federal lawsuit against the city alleging that its ordinance banning unannounced migrant drop-offs is unconstitutional and punishes transportation companies working with Texas, court documents show.

Wynne Transportation LLC is fighting new restrictions in Chicago against buses dropping off one-way passengers without prior notice.

The ordinance does not specifically mention immigration, but city leaders have acknowledged it is in response to the influx of more than 30,000 migrants arriving from Texas on government-contracted charter buses, often dropped off on street corners with little or no notice.

The rules, enacted on December 8 in an effort to slow the surge, require unscheduled one-way buses from outside the Chicago area to get advance approval from the city to drop people off. Violators can be fined $3,000 and have their vehicles impounded, the mandate says.

“Texas bus operators continue to willfully break the law by disregarding regulations designed to ensure the safety of asylum seekers arriving in Chicago,” Mayor Brandon Johnson’s office said in a December news release calling for federal support in addressing the migrant crisis.

At the direction of Republican Gov. Greg Abbott, the Lone Star state has busedover 90,000 migrants to “sanctuary cities” run by Democratic elected officials including New York, Washington, DC, Chicago, Philadelphia, Denver and Los Angeles since April 2022, according to numbers released by the governor’s office December 29.

“Wynne is taking action against the City’s ordinance because it unlawfully interferes with its business and violates Wynne’s constitutional rights and the rights of Wynne’s passengers,” Michael Kozlowski, an attorney representing Wynne Transportation LLC and several other charter bus companies, told CNN in a statement Thursday.

In its lawsuit, Wynne Transportation LLC, which is also caught in the middle of another lawsuit filed in the New York Supreme Court for its non-compliant role in transporting migrants to New York City, argues that the ordinance is intended to limit the flow of immigrants and infringes on the right of the federal government to set immigration policy.

“This case is about allowing immigrants the opportunity to call Chicago home,” the lawsuit states.

CNN reached out to the City of Chicago for comment. It has not yet filed a response to the suit in court, and no hearing dates have been set in the case.

As of December 31, Chicago filed 95 separate lawsuits against approximately 24 bus companies to enforce the unlawful ordinance, Kozlowski said.

“We intend to vigorously defend those cases,” he said, which will begin on January 29 when an initial hearing for 40 of the 95 cases filed by the city will take place, Kozlowski said.

At the same time that the bus company cites federal immigration authority in its suit, the state of Texas is involved in ongoing litigation with the Biden administration over its efforts to arrest migrants, place barriers in the Rio Grande and block Border Patrol agents from access to parts of the border.

The Wynne lawsuit argues Chicago is also violating the constitutional authority of the federal government to regulate interstate commerce by enacting restrictions that mostly apply to out-of-state companies.

“The Ordinance violates both Plaintiff’s and its passengers’ fundamental right of free movement/interstate travel,” the documents state.

New Florida Immigration Rules Start to Strain Some Businesses​

Some employers said they were losing workers because of the new law, which was championed by Gov. Ron DeSantis.


"Juan Baregas, a subcontractor who does framing for a large developer in Central Florida, said that he had lost half of his crew of 40 in recent weeks, limiting his ability to complete projects.
Some were authorized to work in the United States but left Florida because they feared for loved ones who weren’t, he said. Forgoing offers to raise their pay, workers relocated to Houston, Washington, D.C. and New York, where jobs were plentiful and unauthorized immigrants felt less vulnerable, Mr. Baregas said.
“Maybe this law won’t even be enforced,” he said. “But people feel persecuted. They want to live in peace.”"


"Tim Conlan, president of Reliant, a roofing company in Jacksonville, said a subcontractor had recently turned down a project after his workers refused to travel to Florida, preferring to stay in Georgia and the Carolinas. He also said that hourly rates for jobs had increased about 10 percent since the bill was signed into law in May.

“This law isn’t getting to a solution,” said Mr. Conlan, who has visited the state capital Tallahassee to press for policies that would allow his industry to legally hire the workers it needs."

"In a meeting with Hispanic religious leaders before the law went into effect, Rick Roth, a Republican state representative and farmer who voted for the bill, called on the ministers to convince people to stay. “We are losing employees,” he said during the gathering, video of which was widely shared. “They are already starting to move to Georgia and other states.”
In the Florida Keys, where tourism is the economic engine, workers without legal status like Mary-Ann Smith, from Trinidad and Tobago, have been abandoning jobs at restaurants and hotels.
“You come here to have a better life, doing a job that Americans don’t want to do, and then this law comes along,” said Ms. Smith, who worked for years at an upscale eatery and who remained in the country after her visa expired. She said that co-workers from Venezuela, Jamaica, Cuba and Haiti had also resigned. She recently arrived in Maryland, where she is job hunting."

"Cesar Velez, 44, a hairdresser from Colombia who is a U.S. permanent resident, was at the information session to better understand the law. It had decimated his business, which caters to immigrants, he said.
Mr. Velez had been offering free pickups and drop-offs to clients scared of driving, but many others had left the state. “I may have to leave, too, even though I’m legal,” he said."

BOSTON -- Lawyers representing migrants flown to Martha's Vineyard nearly two years ago by Florida Gov. Ron DeSantis can sue the charter flight company that transported them to the island off the Massachusetts coast, according to a ruling Monday by a federal judge in Boston.

The 50 Venezuelans were sent to Martha’s Vineyard from San Antonio, Texas, and had been promised work and housing opportunities.

Under Monday's ruling, the migrants can proceed with their suit against Florida-based Vertol Systems Co., which had agreed to fly them to the island for hundreds of thousands of dollars.

An email to the company seeking comment after the afternoon release of the ruling was not immediately returned.

Also named in the suit is DeSantis, who ran unsuccessfully for the Republican nomination for president before dropping out in January.

The U.S. District Court of Massachusetts said in its ruling that it does not have jurisdiction over DeSantis in this case.

The court, however, found that the facts of the case “taken together, support an inference that Vertol and the other Defendants specifically targeted Plaintiffs because they were Latinx immigrants.”

The DeSantis administration noted that the judges' order dismissed the state defendants.

“As we've always stated, the flights were conducted lawfully and authorized by the Florida Legislature,” Julia Friedland, the deputy press secretary for DeSantis, said in a statement. “We look forward to Florida's next illegal immigrant relocation flight, and we are glad to bring national attention to the crisis at the southern border.”

The court also said that “Unlike ICE agents legitimately enforcing the country’s immigration laws ... the Court sees no legitimate purpose for rounding up highly vulnerable individuals on false pretenses and publicly injecting them into a divisive national debate.”

Iván Espinoza-Madrigal, executive director of Lawyers for Civil Rights, called the 77-page ruling a major victory in the Martha’s Vineyard case.

He said in a statement that the ruling sends the message that private companies can be held accountable for helping rogue state actors violate the rights of vulnerable immigrants through what it characterized as illegal and fraudulent schemes.
