3. The potential opposer is engaged in settlement discussions with applicant.

Looking this up in the database, AEW applied for their mark on Mar 21 2022 in software and clothing categories. GCW applied theirs Jul 21 2022 under entertainment/wrestling but they used Fight Forever first for a show Jan 2021

Long story short, GCW's looking for some fast cash. The timing of their mark is suspect and differences in audience makes confusion nearly impossible. They usually rule with whoever created the initial design or slogan and since GCW didn't create the Fight Forever mark battle cry, AEW can use that basis which is what they were going for in the first place.
