Section of the CBA he's referencing:

It's a bit vague, but it doesn't read like a player is giving up his HIPAA rights. More like it's PROTECTING the player's rights to have access to his records that the team has. This is gonna be interesting going forward if he didn't give consent/waive his HIPAA rights.

As a person who is far from a lawyer but actually deals with contracts on a day to day basis...this is some downright sheisty shyt...

This entire thing talks about how a player can get his own records...which is not what HIPPA is...HIPPA does a lot of things but the main thing it does is make it so your medical records stay private...it pretty much makes it so that the only people who can access your medical records are you...your employer...and whatever doctors office you frequent...that is it point blank period anyone else accessing your records is ILLEGAL...period...i mean damn near no exception...your wife, mother, brother, etc can be brought up on charges for accessing your medical records if they got no consent from you and you really wanted to press charges like that...

But then part B pops up and it is just so layered in lawyer double talk...shyt is :deadmanny:

"To the extent that a players medical or trainer record contain information that is subject to HIPPA"...

Mufukka ALL MEDICAL RECORDS ARE SUBJECT TO HIPPA...there is no such thing as "to the extent" unless somewhere else it states that there are certain things players wave their HIPAA rights to:deadmanny:

Furthermore it says "nothing in this section shall be construed to restrict a players right to access his information"

Mufukka THE POINT OF THE LAW IS SO THAT NOBODY CAN ACCESS THE PLAYERS INFORMATION NOT THE OTHER WAY AROUND:deadmanny:

These fools took a law that is supposed to keep other people from accessing your private medical records and somehow wrote that shyt out so that it sounds like the law allows you to access your own medical records :deadmanny:

How the fukk did the NFLPA not catch this...:dahellwhat:

They got to be in cahoots with the owners I refuse to believe a set of people representing a union could be that stupid not to see what the NFL is trying to do with that statement...:dahellwhat:

it doesnt matter what that clause says. it doesnt apply to anyone at any hospital or doctors office in the country. it applies strictly within the nfl. their rights certainly might be waived when it comes to teams giving other teams a players medical records. thats the extent of it

Hell yeah, ESPN or that hospital ain't apart of the NFL. I really hope that Schefter gets fired for this & they get sued
