No, they are marketing the Cena/Punk feud as one of the two major rivalries this year. They've put too much money into that mode to just take it out.

He does own his name so technically he does have a point. I know if a company was using my name and likeness I would definitely like to be compensated for it. Also the WWE might want to be careful cause Punk's lawyers might try to go at the legal loopholes with the wrestlers being "independent contractors".

As he kept his CM Punk name from the indies to WWE I assume he owns all the rights to it. If they've stopped sending him royalties then he's legally well within his rights to sue them for his image being used in the game.
