Ted Cruz says 'lawless' Supreme Court rulings have led to 'some of the darkest 24 hours in our nation's history'

It's safe to say Sen. Ted Cruz (R-Texas) was horrified by this week's landmark Supreme Court rulings on Obamacare are gay marriage.

In an appearance on Sean Hannity's radio show on Friday, Cruz, who is running for president, made it clear he thought the rulings represented a sad moment for America.

"Today is some of the darkest 24 hours in our nation's history," Cruz said after Hannity asked how he was doing, according to audio posted by Mediaite.

Cruz went on to describe both rulings as "naked and shameless judicial activism."

The first of the two decisions Cruz blasted on the radio came Thursday when the Supreme Court upheld a provision of the Affordable Care Act. In that ruling, the justices rejected an argument that the way the so-called Obamacare legislation was written prevents subsidized insurance in states where the federal government has set up healthcare exchanges.

According to Cruz, this decision amounted to the judges "rewriting" the law in support of President Barack Obama's agenda.

"The decision yesterday rewriting Obamacare ... for the second time six justices joined the Obama administration," Cruz said. "You now have Barack Obama, [former United States Secretary of Health and Human Services] Kathleen Sebelius, and six justices responsible for forcing this failed disaster of a law on millions of Americans and simply rewriting the law in a way that is fundamentally contrary to their judicial oaths."

Cruz has made repealing Obamacare one of the cornerstones of his presidential campaign.

After discussing the Obamacare case, Cruz attacked Friday's Supreme Court ruling that legalized same-sex marriage in all 50 states. He characterized it as an attack on existing state-based marriage laws.

"This radical decision purporting to strike down the marriage laws of every state, it has no connection to the United States Constitution," Cruz said. "They are simply making it up. It is lawless and in doing so they have undermined the fundamental legitimacy of the United States Supreme Court."

He's looking at marriage as a set of government entitlements, rather than a historically rooted right/liberty interest. Being a slave did not exclude slaves from having basic human rights -- they "always" had them. They were just trampled on. But same sex couples do not have the "right' to marry. Nobody really does. It's a right conferred to you by government. Therefore, it is not a fundamental right in the Constitution. The government can take it away as it pleases.

His point is in response to the fundamental right to marriage and part of the dignity that it bestows upon the party that engages in it. Denying one the right to marriage is denying them basic human dignity--a fundamental right.

Thomas argues that all men naturally have dignity and that a law cannot take it away because dignity exists absent any outside factors. You have dignity because you are a human being, not because society says that you are dignified. So even in the most horrible situations you cannot lose dignity, it was freedom that you lost. But you still had the innate trait of dignity because it is not something that can be taken away.

The problem, and absurdity of it all is that of course your dignity--while something you naturally deserve as a human being--can be wounded and taken away by society. You have to accept there are no acts so heinous or embarrassing or humiliating that can cause one to lose self-esteem and feel as though they are incapable of demonstrating self-respect or being worthy of it.

By definition dignity is the state or quality of being worthy of honor or respect. Being placed in chains and told that you are 3/5 of man does not strip you of the quality of being worthy of honor or respect in the eyes of society? Being incinerated in concentration camps as if you're less of a human and being experimented on? The loss of the ability to perform actions which human history has deemed worthy of respect? To accept Thomas' argument you must accept that by saying all men have the natural state of dignity means that dignity is this isolated quality that is not defined in the context of society and that has not been redefined throughout human history. It's bullshyt.

No problem if man marries outside his assigned race or with another man. Also, contrary to what the media portrays with celebrity marriages, California's divorce rates are the some of the lowest in the country. Should be the blueprint.
