I'd say this is more like the friend's girlfriend having a phone full of messages planning to meet with a dude to cheat.
Then she showed up to cheat.
But when she leaves the hotel room she says she didn't actually cheat and thought they were just gonna watch Netflix and chill.
Even your scenario isn't proof of actual sex but to some texting with another guy is cheating. Let's stick to crime analogies not analogies where the definition of 'cheating' is subjective.

I'm not someone who has followed Greenwald closely, but I have valued some of his past investigative journalism and a lot of work of the Intercept very highly.

When it comes to this issue I have consistently seen him make statements that appeared horrifically misguided, almost as if he was in a different reality. My only guess is that he identifies closely with Wikilinks and can't take his personal feelings out of the situation. But its made him look like a fool for three years running.

At least Alan Dershowitz can claim he's only following the letter of the law even when his methods appear misguided. Greenwald can't claim any noble excuse.

The discussion and points are focused on the idea that you can have a strong case for wrong doing without being able to prove it beyond a reasonable doubt. Hence why I pulled it away from a crime analogy, since that would require proof beyond a reasonable doubt.

So it's having messages that plan wrongdoing at a time and place (conspiring for Junior and Cheating for hypothetical friend) and a meeting definitely happening at that time and place (same in both cases); but not being able to say exactly what took place in the meeting.

The reason that I like using cheating, is because when you lay the scenario out, absolute guilt isn't established. But it's not a conspiracy theory for your friend to think she cheated just because he didn't catch her red handed. The red flags were real and Mueller acknowledges as much.

Russiagate is about a crime not wrongdoing that's why the analogy doesn't suffice. Legal experts knew prior and during it would be extremely hard to prove collusion so why go there? It's like the consequences of it not working were never considered even though there was a lot of acknowledgement it probably wouldn't work. It was bad political strategy, now the cannons they pointed at Trump will now be pointed at them.

Glenn Greenwald isn't even a journalist if we're being honest. He literally milked Snowden for damn near 6 years. And Snowden GAVE him the story.
