In short, Article 13 entitled: " The CSPN gives its opinion on any matter relating to the general regulation, training and staffing, discipline, career, remuneration of members of the police " will no longer be respected; since it is replaced by the latter decree which states that " decisions on appointments, transfers at the level of central and departmental directorates, general regulations, training and staffing must be submitted to the CSPN for approval before their execution ". This decision will also consider decisions regarding the discipline, career and compensation of members of the police institution.

The HNP will now be under the full control of the Council since the Director can not make any decisions himself that are not approved by the CSPN. According to Article 14 of the Law on the National Police of 29 November 1994 on the establishment, organization and functioning of the National Police, the CSPN is composed of: Prime Minister, Head of Government, President; the Minister of Justice, First Vice-President; the Minister of the Interior, Second Vice-President; the Commander-in-Chief of the Police Force (the Director General of the National Police), Executive Secretary; and the Chief Inspector General of the National Police, Deputy Executive Secretary.

DECISIONS OF THE CSPN ARE TAKEN BY ABSOLUTE MAJORITY OF VOTES

In other words, by this decree the CSPN has the last word not the Director General and according to article 16 of the Law on the National Police, the decisions of the CSPN are taken by an absolute majority of the votes and are recorded in the register of its secretariat assigned for this purpose.

However, many parliamentarians, even those close to the government, have not welcomed this decree. They have stepped up to denounce it, and even declare it illegal by stating that an order can not have the force of a law, or replace a law. An order can not change a law, said Mario Andrésol, former director general of the PNH.

With this amendment, some parliamentarians even threaten to challenge the CSPN and, strictly speaking, the government so that they clarify this snag which is not in conformity with the law of 29 November 1994. While the parliamentarians react to force the government, as a good mercenary, the one who is the minister of communication of this administration Guyler C. Delva fires all the wood in the press to defend it.

Is it already an electoral power struggle between the Executive and the Parliament when the police director will have no role other than being a mere executive secretary of the CSPN?

Gonaïves: Youri Latortue supporters indexed in former Bordenave delegate's attack inside the Cathedral

Jacques Woobens Bordenave affirms that he will bring complaints before the Public Prosecutor of Gonaives, reported the local correspondent of Rezo Nòdwès, Rolguy Doctor. In the meantime, Senator Latortue disclaims any direct liability for any damage or injury suffered by the former delegate and member of the "Les Indépendants" movement.

((rezonodwes.com)) - A serious incident occurred Sunday morning inside the Cathedral of Gonaives has darkened the celebration of the Feast of St. Charles, the patron saint of the City of the 'Independence.


This Eucharistic celebration, in which several authorities of the city took part, ended with the verbal and physical aggression of Jacques Woobens Bordenave. The latter, according to his relatives of " The Independents ", was attacked by individuals in the pay of Senator Artibonite Youri Latortue.

In addition, Rezo Nòdwès learned that Mr. Latortue was quick to stand out from this brutal action committed on behalf of his party AAA. The former president of the senate and former advisor to the former head of state, Michel Martelly, also revealed that he sent a message to Mr. Bordenave asking him in the name of the common and particular interests of the city of Gonaives, 'bury the hatchet.

Sunday's attack on Bordenave, at the very heart of the Cathedral, came almost 20 days after the famous National Petro-Mobilization Day on October 17, when supporters of both clans came close to hands.




Recall that Jacques W. Bordenave has carved a solid reputation in Gonaives since the formal ban placed by "The Independents" against "Sweet Micky" come to charge insults on the pre-Carnavalesque course organized by the Municipality from the city.

When it was learned that at least two people were killed by police bullets outside the church, the mourners marched with the caskets down the hill to the center of town.

On Oct. 31, hundreds of mourners gathered at Our Lady of Perpetual Help church in Port-au-Prince’s Belair neighborhood for the funeral of six of the seven protestors killed by police during the massive Oct. 17 march against the plundering of hundreds of millions of dollars from the Venezuela-provided PetroCaribe fund.

On Oct. 31, mourners trying to rub tear-gas from their eyes before fleeing the funeral for six of seven demonstrators killed on Oct. 17.

The seven demonstrators killed on Oct. 17 were Jean Kenson Rosier, 24, Dieubéni Casimir, 23, Francky Duval, 25, Junelson Pierre, 23, Jhonny Mervil, 32, Christelle Alexandre, 22, and Mercidieu Baptiste, 53. Father Didy Horace presided over the funeral.

Heavy police patrols in the area outside the church enraged the local population. Around 10 a.m., skirmishes erupted, with protestors throwing rocks and the police firing bullets and tear-gas. The pungent gas filled the church, setting off screaming and panic, as mourners and priests fled from around the coffins and from benches and chairs. Outside mourners angrily denounced the government and the police, many calling for President Jovenel Moïse’s resignation and arrest.

A similar attack took place on Nov. 4 at the Cathedral in Gonaïves, during the Patron Saint’s Day of St. Charles Borromée. Thugs said to be allied with the powerful local Sen. Youri Latortue, a presidential hopeful and close ally of the ruling Haitian Bald-Headed Party (PHTK), savagely kicked and beat worshipers attending a mass during which government officials and Latortue were denounced for their alleged involvement in PetroCaribe embezzlement.

The increased government repression is acting like gasoline on a fire. Popular organizations around Haiti are vowing to redouble their efforts to intensify their PetroCaribe justice mobilizations and bring out even more demonstrators in the month ahead. Anticipation and tension is building around a nationwide mobilization on Nov. 18, the 215th anniversary of the Battle of Vertières, in which the former slaves of St. Domingue defeated Napoleon’s legions, winning Haiti’s independence.

The Assembly of Political, Union, and Popular Organizations denounces with all its strength that the Haitian government has sent police bandits to carry out repressive acts against the people. We recall that on Oct. 17, 2018, about three million people nationwide took to the streets to demand the departure of the group in power along with the arrest of the thieves of the PetroCaribe fund.

Before Oct. 17, President Jovenel Moïse visited several police stations to encourage police officers to repress the population. And just as the indicted president wanted, during the Oct. 17 mobilization, police assassins fired on the people in several departments. The criminals didn’t even spare people inside the church from tear-gas. Even the priest who was presiding over the funeral had to leave the church to escape from the gas.

While saluting the courage of our compatriots who took the lead, the Assembly of Political, Union, and Popular Organizations condemns with all its might the repression carried out by Jovenel Moïse and the CSPN [High Council of the National Police] by sending police criminals against demonstrators.
