Once you have that in mind that's how you approach this. Another option is a longer term debt repayment plan. It will be less per month but you will be paying more for a lot longer. There's like a 99% chance they drop it as long as you agree to come out that $$$. The vast majority of these types of things end up with the person settling.

You sure its not a collection agency suing on behalf of the Capital One account? Normally, banks sell their past due accounts in bulk to collection agencies to write off some of their dead beats. If this is the case, try your best to not talk over the phone and have everything documented in writing.

If it's a collection agency, they are willing to settle for a lower amount, normally they mark-up the amount to turn a profit. It is always negotiable, I try to never pay past 10-15% my original balance, push for lower if you can negotiate well. Good luck to you.
