You sure its not a collection agency suing on behalf of the Capital One account? Normally, banks sell their past due accounts in bulk to collection agencies to write off some of their dead beats. If this is the case, try your best to not talk over the phone and have everything documented in writing.

If it's a collection agency, they are willing to settle for a lower amount, normally they mark-up the amount to turn a profit. It is always negotiable, I try to never pay past 10-15% my original balance, push for lower if you can negotiate well. Good luck to you.

Breh, you know at the end of the day them suing you really isn't gonna do shyt. All its gonna do is make it official (again) that you owe them the money... if you ain't got the money to pay, you ain't got the money to pay. I can't make you have money, even though they'll garnish all your shyt.

Edit: It'll fukk your credit up but I doubt you're worried about that.

They did the same to me breh - Cap one seems to really out to kill mufukkas. They hit me with a suit a few years ago and first things first make sure you reply - thats most important. if you don't a judgment will be decided against you and your wages will be garnished. these companies don't usually have the proof to win this shyt in court so if you reply it may just go away, its kind of a scare tactic.

just recently the case came back to me but in the form of arbitration which 9/10 arbitrator will go agains you - in this case i had to call up the debt collector directly and strike a deal.

so ultimately - just make sure you reply and try to work with the debt collector.

I'll probably end of up doing that.....so if I go wit that approach do u think they'll drop the case...

You can negotiate a settlement. Get absolutely EVERYTHING in writing. And do not deal with them by phone. By correspondence only and send everything via certified mail.

But they DO. Unlike the coli nikkas I live in a real world. I'm not a millionaire and I don't have certs so I know what bills are. My girl co signed for her pops to get a car 8 years ago. He died and the car got repo'd. Last year they asked my girl to pay the remaining $8,000. They said they would take $150 payments every month for however long she said no.Around September she got a call from another debt agency talking about give them $1,200 and they'll call it even.

They sold the debt to another collection company which is standard procedure. You usually have the over a 10K figure for them to directly sue you

Even got Samuel Jackson to do their commercial to appeal to their specific targets. :sas2:

I spend $500 on a capital one card 5 years ago and now they want to sue me help!
Well of course they are going to want their money back.
