You sure its not a collection agency suing on behalf of the Capital One account? Normally, banks sell their past due accounts in bulk to collection agencies to write off some of their dead beats. If this is the case, try your best to not talk over the phone and have everything documented in writing.
If it's a collection agency, they are willing to settle for a lower amount, normally they mark-up the amount to turn a profit. It is always negotiable, I try to never pay past 10-15% my original balance, push for lower if you can negotiate well. Good luck to you.
