If you have a union, I'd definitely talk to them and have a look at your collective bargaining agreement.

If your injury occurred during work hours while doing a work-related activity - you may have an OSHA claim.

If you have communications regarding an injury between you and your employer, as well as you and your physician - there may be something there.

I support fully investigating and seeing what claims counsel may be able to bolster for you.

Imma spoiler it in case they got agents stalking me

ok so I work for Pepsi slanging cases in the warehouse…tough work

Off and on for weeks, my right shoulder blade area was hurting, I worked thru it, usually by the end of the night it’ll loosen and I’ll be good until the next day

Well eventually the morning came that this shyt hurt so bad that I couldn’t go to work…told the manager, set up the workman’s comp and went to the doctor…they gave me an x ray and sent me back on light duty

The day after I seen the dr, the shyt locked up again and I was in excruciating pain…stayed in bed 3 days, on muscle relaxers bc powders Tylenol etc…I had my girl pull a mattress in the living room because I got tired of being in the room

Literally couldn’t stand up..well the day I was supposed to go back, I texted the manager and told him I was hurting and couldn’t come in and I’ll go back to the dr soon as I’m able to

Basically said they don’t give a shyt, the dr cleared me and i need to come in or go to the dr the same day…I had a few words for him and that was that

Well yesterday I went to the dr, they ordered an MRI and excused all days I missed

I come in today, I’m talkin to all my co workers n shyt, the manager come up to me with the gm and they said I had to leave the building because I’m STILL suspended for missing work

Said I didn’t keep communication with them…I said still? They never notified me of a suspension for getting hurt doing their work

Of course I came in with my dr excuse and my work restrictions…so as I’m talking saying I have all my shyt in order, they keep trying to talk over me…and then had the nerve to say I was starting to get an aggressive demeanor and he was getting uncomfortable :russ:

Str8 cracka trigger words…I just laughed and said they’ll hear from my lawyer

Went outside, called a law firm and explained to them and they’re sending the case to their lawyers

These crackas wan war? We can go to war

I missed so much shyt with my kids, with life in general doing that back breaking work..and when my back damn near breaks, they wanna be on some fukk shyt

Got you…well back is 400 weeks, it’s a formula they use to determine your payout…because that’s like the max you can get your benefits for …when they do your lump sum they’ll multiply by it, it varies slightly from state to state…but since you’re getting an MRI. If something is really wrong they can’t really refute it.

But in a year when they do your impairment rating that’s what really matters. You’ll get your IME, just talk about how’s it not allowing you to do certain activities anymore for the most part. You can’t lift. Sleep. Etc…

But they will be watching you so don’t do anything too wild

Let this be a wake up call. I don't know how old you are hopefully you're still relatively young but STOP BREAKING YOUR BACK FOR THESE CRACKAS man they don't give a fukk about you they're in a management position in a ac office while you're out there on some 1863 mississippi field negro shyt literally breaking parts of your body just to live check to check....instead of focusing on a lawsuit go pick up a trade or learn a skill thank me latter:hhh:
All i took from op. If you working to the point that you always hurt or feeling injured often, you either doing it wrong (against most warehouse policies) or you need to pace it down and share the workload. You might have a case if they press for productivity over maintaining a safe working environment.

I deal with a warehouse too and after so many times of feeling like i over exerted myself, i just toned it down slightly and made sure i got in a decent stretch on breaks. Sometimes i still go super hard just for the workout, but I'm not killing myself just for these folks to replace me with a carousel of mfs til they find another sucker to do the same thing.

If your work involves manual labor, you need to practice proper lifting and stretching, eat good, get an adequate amount of rest, and drink plenty of water. If you do all that and still end up injuring yourself, it might be time to hang it up and find something else to do

Right now, I feel perfectly fine

I’ve been avoiding lifting, so I’m not sure if I do lift something if it’ll lock up again

I guess the mri will tell if there are any tears or anything

U can’t get an adequate amount of rest when u get off at 3-4 and gotta be back in at 3

True and partially true. @CouldntBeMeTho with that slave ass schedule, but get your money breh. And good luck on the lawsuit. I hope you come out never having to work again

Damn I work for Pepsi to they do be on bull shyt sometimes but I’m not in the warehouse so I can only imagine. They always hiring.

First ask lawyers if you have a real case. If you don't, I would forget the lawsuit and get your CDL A
