Oral sex is not penetration, so its not rape. That has historically been classified as sexual assault. You woulda had a better case saying its sodomy (i believe that includes anal and oral sex). What makes THIS case different in principle? In all criminal cases, the accuser (plaintiff) bears the burden of providing the defendant's guilty BEYOND A REASONABLE DOUBT.

Rape is a crime so the "beyond a reasonable doubt" standard applies.
