I'm in Illinois, and both GEICO and his insurance company said they can't get the money back til he reports the accident. but he can't get his car fixed either, cuz my insurance company ain't gonna pay for his repair.

its not like GEICO is lying to me about this. They paid like $6000 in repairs for my car and I paid $1000. we both wanna get our money back.

dog that makes absolutly no sense........

that's their job to track that nikka down and get thier money back........

if they cant find him then its treated like a uninsured motorist accident where you are basically sueing them nikkas

That just isn't true. There's nothing for the individual to report once there's a police report.

What you're describing is how things work when someone doesn't have insurance, or the police declared it a no-fault accident.

yeah, just got my car this morning. there's no way I can get reimbursed for the $1000 I paid for the deductable unless he reports the accident or the insurance company or me come after him court-wise.

Well, at least you got your car back. I know you hated paying that $1,000, you do what you gotta do man. So does the car drive the same since you got it back? You know they say that once a car is wreck it doesn't truly ride the same.

always get that police report on file. especially with someone that seems suspect or is attempting to deny liability. that nikka probably only had liability coverage, so there was no reason for him to call in a claim. he definitely ain't tryna help you out, lol.

even if you have all his info and file a claim with his company, they still have to actually get a recorded statement from dude admitting fault, before anything will be paid out. since you wanted to go ahead and get your whip repaired, you still had to pay your GEICO deductible and they would attempt to go after his company.

this is a small claim, breh. you could be waitin' until the end of the year for GEICO's legal team to get you your paper back. they have bigger fish to fry. you'd be better off gettin' your own legal representation and goin' after dude personally. smalls claims court. put the nikka on a payment plan. good luck.

car drives fine. it was weird, cuz I had a little chevy cruz for two weeks, and when I started driving my car, I wasn't used to the increased HP, better handling, and breaking ability despite my car being a 05'. and you saw the pics which didnt look like major damage initially, but it ended up being almost $7000.

by going thru one of GEICO's recommended shops, the warranty for the work is guarunteed forever both thru that shop and thru GEICO, so if anything goes wrong, they'll fix it free no questions asked.

Exactly. The police report doesn't indicate fault. If it did, there would be no issue. But I'm going to go ahead and let you know that if the police determined it a no-fault accident, your chances of recuperation go down pretty significantly.

nope. cuz i was solo, and he was solo. plus no one was really on the ramp. only thing good is my insurance adjuster could look at my car and see the big dent the back of my car and determined I was hit and are not gonna raise my rates.

Well good then man, I hate that you had to go thru that shyt with the dude not filing the report but you got your car back and got a lifetime warranty.

UPDATE

So I got this letter in the mail the other day and called them. looks like African dude's shytty insurance doesn't wanna pay up. so I call the lawyer, and she says I'll have to come to some kinda arbitration. she said since his shyt insurance is substandard, they still try not to pay up. a lot of these cut rate insurance companies won't pay claims in hope that if they get taken to court you won't show up. I told her, that since I work at home, I got all the time in the world to go to court and potentially collect my $1000. basically, once we win this case, they have to pay up, or their bank account will get frozen til we get paid.

Lol. Beans is my dude, but if you didn't call police your a moron. People change their stories and lie all the time. Police report is essential in preventing this.

I did call the police when this happened. but since it happened on a busy on ramp to an expressway downtown here, the state police had us both moved to an accident area like 5 minutes away from where it happened. I got a report, but the police refused to assign blame to him even tho I was rear-ended since there were no witnesses. they ain't even give dude a ticket :wtf:
