I understand the difference completely....This is not copping a plea really, it's a negotiation between the opposing counsels... but there is enough to ask the question.....If someone really wanted to grab his docket, from Pacer, we would know. There will be sealed motions right before the sentencing, those would be the motions for downward departure based on cooperation. His guilty plea called for a 10 year minimum, and they gave him 8-10, allowing him to serve maybe 6....I also understand he had a prior federal conviction for trafficking or am I mistaken? If thats the case, it makes it much more unlikely he received that favorable of a deal without cooperation.

Back in 01 yeah but I never heard any thing about him snitching so I wouldn't put that on him.

Two different types of snitching.
There's a certain type of snitching/cooperation, I forget the label, that involves telling on anybody and everybody involved in YOUR case. The safety valve.
Then there's the 5k1...

There is Rule 35, and 5k1, and both are about the same, in terms of cooperation.....5k1 is a motion filed by prosecutors before the sentencing, to influence the judge to reduce the sentence.....Rule 35 is applied after the sentencing.....And safety valve is for lower level members, with no violence, no ties to organized crime, and a first offense. You have to fully admit YOUR role in the crime, thats not snitching....dependant upon other variables. No way Mendecces qualifies for a safety valve, as he had a leadership role in the conspiracy, and a prior.

From my understanding, having a prior federal conviction for trafficking is a 20 year minimum, in the instance you catch a new case for the same or similar offense. If thats true, no way dude got this deal without cooperation. Or at least makes it extremely unlikely.
