Nintendo reserves the right to brick your console following "unauthorised use", in bid to prevent piracy.

they should also send a refund with that killswitch.
You should be able to return your device to Nintendo now and get a prorated refund but going forward if you agree to their terms and conditions it is what it is and if you don't agree you shouldn't buy any more of their hardware.

This whole controversy is just rage bait. Bricking consoles used for piracy has been an industry standard since the PS3 and 360. Nintendo's just gotta be the bad guy for some people.

Sony's Terms of Use: PSN Terms of Service

12.6. Other Remedial Actions. If we determine that you or any of your associated Child Accounts have violated this Agreement (including the Community Code of Conduct, the Usage Terms, or any other incorporated terms), or that your actions have injured or damaged SIE or the PSN community, we reserve the right to take any action we believe necessary to remedy the violation or to protect SIE’s interests, including: (a) the automatic removal or blockage of content associated with those Accounts; (b) implementation of upgrades or devices intended to discontinue unauthorized use; (c) the permanent or temporary disablement of access to any PSN Content, PlayStation Devices, products, services or features; (d) notifying law enforcement or the appropriate authority; and (e) initiating legal action.

Microsoft can do it too: Windows 10 can disable pirated games and illegal hardware

I dunno if it was this severe but if any company found out you had a hack console, in past generations, they would ban your console from online services at minimum.
Correct, and some Xbox 360s were getting bricked. This isn’t actually new.

If you’re gonna roll those dice and mod your console to pirate, keep it offline. Nothing’s changed.
