Stoller is wrong only real argument the DOJ will have in merger law is competition and consumer disruption argument, and that's a hard argument to make. The best arguments will be the horizontal aspect of the merger in case law but unfortunately their has been several precedents already set. I'm sure they looked at the abk/ms merger and will use similar arguments and remedies. Netflix will be prepared to fight whatever ftc and doj brings this may last years.
