The tackle analogy fails when you consider that Suarez also got that covered with his tackles on Distin and Mirallas, actually Mirallas got him back last season. You would have to establish malice as the motive for a particular type of tackle unless it is the Roy Keane/Haaland thing when the other player admits he had the motive to break his legs.
