if they don't adopt it they won't be selling used X1 games plain and simple...something is better then nothing...
The point is that there is no benefit for the consumer to buy used games.
think about it...M$ has already said that they would charge the retail price (maybe - $10 of retail) on used copies. This means that you go buy a used games at gamestop, who will most likely charge $20-$30 just for them to profit of the sales of used games. The consumer has to pay this cost + the cost to play the game on console. So why would someone go and buy a used game.
This strategy effectively kills the used market. No consumer is dumb enough to make two different transactions, when they could just make one by buying a new copy of the game.

and will open up a bunch of lawsuits since Eulas are kind of shady . Any time you have to agree to a contract and its take it or leave it and the terms come up after the item is already purchased it leaves alot of grey . You think ms wants a bunch of lawsuits and negative press ?
