I think Tory’s lawyers obtained a lot of info during discovery.

I think they know whether or not a weapon was discharged, who out of the four had gun residue on them. All the prints that were on the gun. Who made what statement to the police, who was intoxicated and on what substance. They might even have portions of the medical records if it was obtained by the police. They know if the injury is consistent with a glass cut or bullet graze etc.

I'm not saying that i know what happened. All I'm saying is that like the ig lawyer said, Tory seems VERY confident on the album...
