Employers are obligated to pay $2.70 an hour to waiters, and have their tips make up or exceed the minimum wage. However, if their tips do not, they must pay the rest so that they make at least the minimum wage. It's Federal Law. This "we don't make minimum wage" is horseshyt.

How many $20 tips before you're over the minimum wage threshold? If he's eaten $50 worth of food $20 would be generous....but since he spent $500 he's a miser. Either $20 is a good tip or not

But the waiter takes more than double the money home in tips in the second scenario.
They should do what we do here...include everything in the price including taxes instead of shaming people into subsiding the employer. It must be a nightmare to go out as a group in the US.
The price you see is the price you pay. If people want to STILL tip beyond that then that's their prerogative but no one scrutinises their behaviour.
