People don't understand "public domain". When you're out recording random shyt or yourself, then yeah other elements can be captured during that adventure. However, you CAN NOT record someone's image and likeness with the intent to monetize (views, comments, revenue).

Specify the event. If you're talking about a conflict (potential crime in progress) that's an entirely different thing. You're attempting to move the goalpost to be correct. As a general rule, you CAN NOT just record a drunk female (especially with a skirt on) at night. Why do you think the police officer told them to back up and not the boyfriend? Think about it.

The law gives us freedom of speech but if you walk up to a couple and call the wife/gf a slut, the husband/bf will likely try to break your jaw(or flat out shoot you) on the spot.

The law(in some states) says that pedestrians have the right of way at certain crosswalks and in parking lots(think supermarkets). However, if you blindly step out into these crosswalks just because “you have the right of way and vehicles are supposed to stop !”, you will get run over and killed.
