You clearly don't understand the law. First of all, she's a female, so recording her unconsented is extremely shakey by itself. Then that fact doubles when the girl is drunk. The guy recording could be labeled a stalker at that point.
People don't understand "public domain". When you're out recording random shyt or yourself, then yeah other elements can be captured during that adventure. However, you CAN NOT record someone's image and likeness with the intent to monetize (views, comments, revenue).
Yet all those people who get recorded in public during freakouts/events etc never sue. And those videos get monetized.
Specify the event. If you're talking about a conflict (potential crime in progress) that's an entirely different thing. You're attempting to move the goalpost to be correct. As a general rule, you CAN NOT just record a drunk female (especially with a skirt on) at night. Why do you think the police officer told them to back up and not the boyfriend? Think about it.
And yes, those people usually don't sue, but the point is THEY CAN, because they aren't legally allowed to just do that like they claim.
