All that doesn't change the fact that the league will have a tough time justifying its punishment. You bringing up Roethlisberger and Hardy doesn't make it more likely that the league's punishment was legally justified under either the arbitrary and capricious standard or the conduct detrimental to the the league standard.

Wells didn't have a tough time justifying the conclusion of that report though

Wells was not an independent investigator. He was hired and compensated by the league and has a history of siding with the establishment. Moreover, the report is VERY flawed and the NFLPA's attorneys will have no problem discrediting it.

Just because Wells made certain conclusions doesn't mean they're valid. A judge will review his report with a skeptical eye.

They're not independent because NFL decided to hire him? Seriously? So who should've hired the independent investigator? The Pats?

Secondly, if Ted Wells is non-objective, why didn't Pats raise concerns about the man that was going to be doing the investigation on them? After the Super Bowl everyone though Deflategate had came and went but during the 4 month period NO ONE said a bias investigator may implicate the Pats for this.

Lastly, how is the report flawed? There's way too much damning circumstantial evidence in it to NOT give Brady AT LEAST 2 games.

Withholding the most important piece of evidence from an investigation on cheating is conduct detrimental to the league.

1. There should've been an independent investigator mutually selected by the league and the union. Perhaps the NFLPA will bargain over this term next collective bargaining go-around.

2. The union most likely didn't raise hell because a league - selected investigator was probably collectively agreed upon via the CBA. But like I said above, the union should bargain over this term next time.

If you can get over the fact it's from Breitbart, you'd see that this article raises substantial issues with Wells' report. The comment section is also intellectually stimulating.

Brady had no obligation to turn over his phone. The CBA states this and there are federal laws that make it illegal for employers to demand employees to turn over their personal phones and emails or punish them for refusing to do so.

In the grand scheme of things doesn't matter if the suspension gets reversed. Pats can probably go 2-2 without him, and if not they'll still be a playoff team. Will be a little tougher with no HFA but they weren't guaranteed that Brady or no Brady. Good luck getting those draft picks back though. And no one is going to magically forget that Brady cheated.

Yes, the league did get a chance to prove Brady's guilt when it conducted it's investigation. You can't be this obtuse.
