the OG artists deserve something 99% of the time but there should be a limit on how long you can wait or how much you can get if the sample is on an album/mixtape like Section80 is. i thought it was a free download with some hard copies available to buy but i don't think it sold that much anyway mostly it was free downloads.
Section 80 was a mixtape but then they decided to sell it because of the massive downloads

i feel both sides. but i gotta side with the original artist at the end.

say some unknown rock/folk/country music artist replayed a small but distinct part of a hip hop beat for a song. and they use it as the main riff. then, say later on, that unknown rock artist blows up and sells millions. you really think these hip hop producers wouldn't sue as well?

All of that is already true. There's a statute of limitations on copyright infringement and the court will impose a limit on damages based on how much $ the song and mixtape generated. Sometimes they take the promotional value of the song and whether the artist performs it live.

Interscope dropped the ball for several reasons though. They didn't clear the sample, and they didn't remove the song altogether when they started selling it as an album. When Drake put So Far Gone on iTunes and in stores, they removed the songs that weren't cleared.

s80 wasn't released under Interscope & TDE wasn't even linked with interscope at that time...

Schoolboy Q signed to interscope in 2010/2011 but TDE was still an independent label. Kendrick signed to Aftermath/Interscope AFTER the release of Section 80 and TDE decided to make a deal with Interscope.

Interscope still gonna take care of this shyt because he's now one of their artists. it's what the labels always do. And even if they didn't want to help him, you have to keep in mind that TDE has 3/4 indie artists which mean they make a lot of profit.
Also, Kendrick is homie with a hip hop billionaire... and even if kendrick HAD to deal with this shyt, don't forget that kendrick made 9-10 millions (according to forbes) off touring in 2013 Alone.

they're asking a milli but they won't even get paid half of that amount and
