In the grand scheme of things doesn't matter if the suspension gets reversed. Pats can probably go 2-2 without him, and if not they'll still be a playoff team. Will be a little tougher with no HFA but they weren't guaranteed that Brady or no Brady. Good luck getting those draft picks back though. And no one is going to magically forget that Brady cheated.

The league can't prove he cheated, hence the imminent appeal. And he still has his 4 rings. :umad:

1. There should've been an independent investigator mutually selected by the league and the union. Perhaps the NFLPA will bargain over this term next collective bargaining go-around.

2. The union most likely didn't raise hell because a league - selected investigator was probably collectively agreed upon via the CBA. But like I said above, the union should bargain over this term next time.

Brady had no obligation to turn over his phone. The CBA states this and there are federal laws that make it illegal for employers to demand employees to turn over their personal phones and emails or punish them for refusing to do so.

For workplace investigations, the employer makes the rules. And when the employer expects cooperation, anything other than significant sanctions for failure to cooperate will invite others to refuse to cooperate.

During the various significant NFL investigations in recent years, cooperation has been consistent, and automatic. The Saints cooperated when the NFL was investigating the bounty case. The Ravens cooperated when the NFL was investigating the Ray Rice elevator video. Per multiple sources, Ravens employees automatically and without hesitation surrendered their cell phones for forensic examination that entailed a specific search for certain recipients and phrases. The procedure balanced the needs of the investigation with individual privacy rights.

Here, multiple individuals chose to extend their privacy rights so broadly that it interfered with their obligation to cooperate with their employer. Separate from whatever the Patriots did or didn’t do to the footballs, the failure to cooperate requires punishment, or others will do the same thing in the future.

nope wells gave his lawyer permission to turn over the texts only and he didn't even need the phone . Yet Brady refused . Also the conduct detrimental to the league is more complicated than your making it

And they still refused.

1. For the last time, Brady had no obligation to turn over his phone and it's illegal for the league to punish him for not doing so. Wells giving Brady's lawyer permission to do so is irrelevant.

2. The "conduct detrimental to the league" standard is broad and vague. And the onus will be on Goodell to prove how BRADY engaged in conduct detrimental to the league based on the findings in the Wells' report. In short, Goodell has a lot of 'splaining to do pertaining to his decision to suspend Brady based on the report.

You're making this analysis more complicated than necessary.

That doesn't matter, the league had no legal expectation to see the contents of Brady's personal phone. Stop playing semantics.

Because I'm arguing with the law and facts. I'm breaking down all of your arguments under the same applicable legal standards of the appeal. You're arguing off emotion because you want Brady to be guilty.
