Several years back i had a stake in a production team whose marqee artst was being offered a 360 deal by WARNER/ASYLUM
It was like a 75 page document that came off rather vague and ambigous as far as Warners intent and the obligations of the production team
long story short ...I RETAINED A LAWYER
Best decision i could make
Come to find out thru my counsel that the 360 deal had no real benificial value to the artist
First of all as my lawer pointed out thru research.neither WARNER or any of the labels had the infrastructure in place to help capitilize off an artists merchandising.....
what new artist has his own shoe deal...clothing line etc. that is parallel to his music career that the label is able to place in major retailers and apparell shops worldwide?
Also lets talk about touring....is it wise for an artist to give up that stream of revenue.when the label is already eating off sales..and publishing?.....
And for the record most Majors are clueless in how to get an artist to reach irs target fanbase cause they are so intent on making them go POP that they lose the original fans to begin with...
So why in the hell would u want your RECORD COMPANY being ur tourbooking agent?!?!
See the key phrase here is CONFLICT OF INTREST
U dont want ur RECORD COMPANY being ur tour manager..publisher...publicist..and.merchandiser
this NEVER ENDS WELL....thats TOO MUCH POWER IN THE HANDS OF ONE ENTIITY
also if an artist was grinding for years to create that local and regional buzz WTF does he need a major for to simply eat off the plate he created?!?...it doesnt make sense
that contract i witnessed along with most 360 deals jist allow labels to reap the benifits of u doing all the leg work and taking risks financially.without them lifting one finger!
And the advances they offer are horrible ....most 360 deal advances range from 15,000 to 25,000 to the artist ..with the budget hovering around a meager 100,000 just to obtain your whole body of work and all the rights which could.potentially be worth millions....THATS SOME BULLSHYT
keep in mind we are in a SINGLES BASED ERA right now the album is becoming OBSELETE...it doesnt make sense for an artist to sign away all hiis rights in one deal..when he has the opportinity and leverage to negotiate various deals for each single that the label is intrested in promoting
Also u have to factor in its 2014...most labels are using outdated contracts which dont address or incluse the idigital adpect of the game such as STREAMING..DOWNLOAD SALES..and the monetizing of YOUTUBE/VEVO videos.
the labels are EATING off of streaming hits and download sales and.most artists are not seeing revenue from that
pandora...spotify and many.other streaming and.digital networks have HORRIBLE PAYOUTS to the artists...cause.the labels and publishers have negotiated side deals which dont take into consideration the artists intrests.
