End of the day there's nothing here to defend on Kendrick's part. He sampled it, pay up. Simple as that.

How you jump on the OG who wants his deserved cut? You took his shyt right? You know you're sampling when it's all said and done so don't act naive when you get caught up.

I'm not sure but from what I understand The actual sample has to be 3.5 seconds long for it to do any real damage. The homie is goin through the same thing with the Jackson 5 sample for Eric BBellingr "I Dont Want Her" but because he sampled barely 3 seconds of the song , damages won't be so bad

This is not new band it won't go anywhere. he ain't sued by someone who wants recognition for his music, hes being sued by someone who HATES hip hop.

I see it both ways. I know that artists that get sampled deverve a check, recognition, or something.

On the other hand, I can't stand when it comes to lawsuits just because cats are already terrified to sample, and it just makes it worse and worse. Salute to producers that still have the balls to go and dig. Alchemist said he lost every fukking penny for Break Da Bank with Schoolboy Q but it was a dope sing so it was worth it. Someone just posted something this week about how Just Blaze had to give up 100k and 100% of the publishing to Supertramp for Fabolous' Breathe.

It's crazy.

If it's not that serious then Kendrick (or whoever produced the record) shouldn't have sampled it.

And of course you're going to wait until the other person has money to pay up. Otherwise you just lose money and resources on your end for the hassle.

The sampling laws are so harsh, the whole art form of sampling is endangered. This situation is interesting, because at the time section 80 was released, TDE probably had modest sales expectations of 50k or so, so they probably decided to take the risk on clearing the samples. Kendrick just went on to be much bigger than that.

To me whenever an artist hates hip hop like this dude and he gets sampled, I wish there was a way to know so producers won't fukk with them dudes in the first place. There should be some kind of master list of artists who respect the culture of sampling And are down to be sampled so we know to stay away from cats like this. Nothing worse than sampling one of these elitist type artist who look down on the culture.
